救生員在救人時,法律究竟保護他多少?

16 歲救生員 Ryder Williams 在海邊英勇救人的行為,到總統表揚的過程中,還有可以延伸到救生員的法律地位、注意義務、緊急救援免責、雇主責任,以及台灣救生員制度。 一、先看這起 Santa Cruz 事件 2026 年 7 月 25 日,16 歲救生員 Ryder Williams 在 Santa Cruz 的 Seabright State Beach 執勤時,發現 10 歲男孩 Nathaniel Rai 被強勁海浪與離岸流帶離。 Williams 立即通報支援並下水救援,在非常強的海象中持續抓住男孩,直到另一名救生員抵達協助。男孩當時甚至一度失去意識。這段救援影片後來廣泛流傳,並在 8 月 17 日受到白宮表揚。 這個案例真正值得研究的是: > 如果救生員為了救人而自己受傷,甚至因救援行為造成被救者二次傷害,他是否會被告? 答案不是單純的「有免責」或「沒有免責」。 二、最重要的法律區別:救生員不是一般路人 這是分析救生員法律保護力的核心。 一般人在街上看到有人溺水,法律上的地位可能是「善意第三人」。 但是: 救生員是在履行職務。 因此他的法律關係通常不是: > 我自願救你 → Good Samaritan → 我受到免責 而比較接近: > 你是我執勤範圍內的受保護對象 → 我具有專業注意義務 → 我必須依照訓練及合理標準提供救援。 這個差異非常重要。 California 的 Good Samaritan 法規確實對緊急情況下提供醫療或救援協助的人提供一定程度的民事責任保護;但這並不代表執勤中的專業救生員可以把所有執勤責任都套進 Good Samaritan 免責。 換句話說: Good Samaritan protection ≠ Lifeguard immunity 三、救生員的「法律保護力」可以拆成五層 我會把它整理成下面這個模型: 層級 保護來源 保護內容 ① 緊急救援免責 Good Samaritan 善意、合理的緊急協助可能受到保護 ② 專業行為標準 Lifeguard training 按照訓練、SOP、合理專業標準行動 ③ 雇主/政府責任 Employer / Government 個人救生員不一定承擔全部賠償責任 ④ 公共設施責任 Premises liability 海灘、泳池、警示、救援設備等可能涉及經營者責...
